These Terms & Conditions constitute a legally binding agreement between you and BMM Autosports LLC. Checking the acceptance box, clicking a payment button, submitting a payment, or taking possession of a vehicle each constitutes your electronic signature and your full acceptance of this entire agreement, including all sections below. Your acceptance is recorded with a timestamp, the version of these terms, and your IP address as evidence of agreement.

You represent and warrant that you are the authorized holder or an authorized user of the credit card, debit card, Venmo account, Zelle account, or other payment instrument used, and that you are legally permitted to make the payment. You authorize BMM Autosports LLC to charge the full amount presented, including the disclosed card processing fee, to your selected payment method.

A valid credit card on file is required for all rentals. You authorize BMM Autosports LLC to charge the credit card on file for the rental, any applicable security deposit, and all incidentals, including but not limited to tolls, parking fees, citations, cleaning fees, fuel, damage, late fees, and any additional charges arising during or after the rental period, unless otherwise agreed by BMM Autos in writing.

Your satisfaction matters to us. If you ever have a question or concern about a charge, please reach out to us first at bmmautosportsllc@gmail.com. We are committed to reviewing every billing concern promptly and working with you in good faith to make things right — most issues can be resolved quickly with a simple conversation.

Because you knowingly and voluntarily authorize each payment, you agree to contact us to resolve any billing concern directly, rather than filing a chargeback, payment dispute, or reversal with your bank or card network before giving us a fair opportunity to help. You agree that this acceptance, together with the recorded timestamp, terms version, and IP address, serves as evidence of your authorization and consent, and may be provided to any card network, bank, payment processor, or court as proof that the transaction was authorized.

If a chargeback or dispute is filed without first contacting us and allowing a reasonable opportunity to resolve it, you agree to remain responsible for the disputed amount, any related fees incurred by BMM Autosports LLC (including processor dispute fees), and reasonable costs of collection.

Renters must be at least 21 years of age (or the minimum age required by the applicable rental platform, whichever is greater), hold a valid, unexpired driver’s license, and maintain valid automobile insurance acceptable to BMM Autos. You must provide accurate identification and contact information. BMM Autos reserves the right to refuse or cancel any rental at its sole discretion.

A security deposit is required for rentals and will be collected or authorized on your payment method on file. The deposit secures against damage, excessive cleaning, missing items, tolls, citations, and other charges. Any lawful deductions will be applied, and the remaining balance (if any) returned after the vehicle is inspected and returned in acceptable condition. The deposit does not limit your liability.

You may cancel a reservation within 24 hours of booking for a refund of amounts paid, less any non-refundable processing fees. After 24 hours, reservations are non-refundable except at the sole discretion of BMM Autos. Card processing fees (3%) are non-refundable in all cases, as they are incurred and paid to the processor. No-shows and early returns are not eligible for refunds.

You are solely responsible for and agree to pay all tolls, parking fees, parking or traffic citations, red-light and toll-camera violations, impound fees, administrative fees, and any other charges incurred during the rental period, regardless of when they are assessed to BMM Autos. You authorize BMM Autos to charge these amounts, plus a reasonable administrative fee, to the payment method on file.

You agree that you will not, and will not permit any person to:

• Operate the vehicle under the influence of alcohol, drugs, or any impairing substance;
• Use the vehicle for any illegal purpose, race, speed contest, or off-road use not authorized in writing;
• Sublease, rent, or transfer the vehicle to any unauthorized driver;
• Use the vehicle for towing, hauling, or commercial ride-share/delivery without written permission;
• Smoke or vape in the vehicle, or transport pets without prior approval (cleaning fees apply);
• Remove the vehicle from the state or country without written authorization;
• Tamper with the odometer, GPS, or any equipment.

Any prohibited use voids applicable protections and makes you fully liable for all resulting loss.

You are responsible for the vehicle from the time of possession until it is returned and inspected. You are liable for all loss, theft, damage, or diminished value to the vehicle, regardless of fault, and for any loss of use during repair. You agree that your personal automobile insurance and/or the coverage provided through the rental platform is primary. BMM Autos is not responsible for providing insurance coverage to you. You agree to promptly report any accident, damage, or theft.

To the maximum extent permitted by law, BMM Autosports LLC, its owners, members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, personal property, or bodily injury, arising out of or related to your rental, use of any vehicle, any payment, or these terms, even if advised of the possibility of such damages.

In no event shall the total aggregate liability of BMM Autosports LLC exceed the total amount you actually paid to BMM Autosports LLC for the specific transaction giving rise to the claim. You use any vehicle and service at your own risk.

You agree to defend, indemnify, and hold harmless BMM Autosports LLC and its owners, members, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, fines, penalties, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of a vehicle, your violation of these terms, your violation of any law, or any act or omission by you or any driver or passenger.

You knowingly and voluntarily assume all risks associated with operating and using the rented vehicle. You release and forever discharge BMM Autosports LLC from any and all claims arising from your use of the vehicle, to the fullest extent permitted by law.

These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Subject to Section 14, venue for any action shall lie exclusively in the state or federal courts located in Grayson County, Texas.

Please read this section carefully — it affects your legal rights. Any dispute, claim, or controversy arising out of or relating to these terms, any payment, or any rental shall be resolved exclusively by final and binding individual arbitration administered under the rules of the American Arbitration Association, seated in Grayson County, Texas, rather than in court, except that either party may bring an individual claim in small-claims court.

You and BMM Autosports LLC waive any right to a jury trial and agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

We collect and store the information you provide (such as name, phone, email, billing address, payment details processed by our payment processor, and rental notes) to process payments, fulfill rentals, and maintain records. Card details are processed securely by Stripe; BMM Autos does not store full card numbers. We retain payment and agreement records, including your acceptance timestamp and IP address, as business and legal records.

If any provision of these terms is held unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable. These terms constitute the entire agreement between you and BMM Autosports LLC regarding their subject matter and supersede all prior agreements. BMM Autos may update these terms at any time; the version in effect at the time of your transaction governs that transaction.
